Legislation

The Department of Local Authorities administers two Acts being:

1. Decentralization Act Cap 230
2. Local Produce CESS Act CAP 207

Decentralization Act

The purposes of this Act are:

• To provide a legal framework and foundation for the establishment Provinces and Area Councils to represent the interests and respond to the needs of them
  communities,
• To provide local governments with the powers, duties and functions necessary for fulfilling their purposes, and
• To provide local governments with the flexibility to respond to the different needs and changing circumstances of their communities.

Local Produce CESS ACT CAP 207

The purpose of this Act is:

• It established a CESS (a type of Tax) on specific production and Marketing of certain Agricultural products to generate Revenue for the Provincial Government
• Certain Percentage of the Funds collected should be used to support Agricultural Development, research, and infrastructure that benefits local farmers.
